1. Scope
This Location Services Policy explains how Uni-X, Inc. ("Uni-X," "MemeKick," "we," "us," or "our") handles location-related information in connection with the MemeKick website at memekick.com, the MemeKick mobile application, and related features, interfaces, and services (collectively, the "Service").
This Policy supplements the MemeKick Privacy Policy, which describes our broader personal-information practices, legal bases where applicable, retention practices, disclosures, and privacy rights. If this Policy and the Privacy Policy address the same location-related practice, they should be read together.
2. Location-Related Information We Process
2.1 Approximate Location from IP and Network Information
When you use MemeKick, we may receive an IP address and other network information ordinarily generated through use of an online service. We may use that information, directly or through a service provider, to infer an approximate area such as a country, region, state or province, or comparable general geographic area.
This type of network-derived location does not require you to grant MemeKick device-level location permission. IP and network location signals can be incomplete, stale, imprecise, affected by mobile routing, corporate networks, VPNs, proxies, relays, travel, or other technical factors, and may not reflect a User's legal residence or exact physical location.
2.2 Approximate Device Location When You Create Content
When you create or upload content in the MemeKick iOS app or on the MemeKick website, the app or your web browser may ask for permission to access your device's location. In the iOS app, this permission applies only while you are using the app; MemeKick does not request background location access.
If you grant permission, your device's location is read at the time of upload and reduced to two decimal places (approximately 1 kilometer) on your device before it is sent to us. In the iOS app, the app also sends general area names for that location, such as the state or province, city or district, and neighborhood. The website sends only the approximate coordinates. We store this approximate location, and any area names, with the content you upload, and they are associated with your Account. Neither the MemeKick iOS app nor the MemeKick website sends your precise device coordinates to us.
In the iOS app, your device uses Apple's location services to determine the area names, under Apple's own privacy terms, before the coordinates are reduced and sent to us. On the website, your browser and device determine your location under their own terms.
Location permission is optional. If you decline, turn off location access in your device or browser settings, or turn off the location option when uploading on the website, you can still create and upload content, and no device location will be attached to it.
2.3 User-Provided Geographic Information
Information that you voluntarily provide about a country, region, residence, service area, eligibility profile, billing or transaction context, or other geographic fact is separate from network-derived approximate location. Where such information is requested, MemeKick may use it for the disclosed purpose, including account, eligibility, compliance, transaction, security, or support purposes.
2.4 Location Information Embedded in Uploaded Files
A photo, video, or other file that you choose to upload may contain embedded metadata, including EXIF or similar metadata, that can include location-related information. Separately from the approximate device location described in Section 2.2, information embedded in the file may be included in the file received by the Service.
MemeKick may process embedded metadata as reasonably necessary to receive, transcode, secure, troubleshoot, moderate, store, or archive an upload. MemeKick does not use embedded precise-location metadata for ordinary location-based advertising or cross-context behavioral advertising. If you do not want location metadata included in an uploaded file, you should remove it before uploading.
3. How We Use Location-Related Information
We may use approximate location, related network information, the approximate device location and area names described in Section 2.2, or geographic information you provide when reasonably necessary to:
- operate, secure, maintain, and protect the Service and User Accounts;
- detect and prevent fraud, abuse, unauthorized activity, account takeover, manipulation, and security threats;
- localize the Service or provide language, regional, support, or availability-related experiences;
- personalize the Service, including recommending memes that may be relevant to your general area, using the approximate device location and area names described in Section 2.2. We may begin or expand this use as we introduce location-based features;
- determine general Service or feature availability and supported-market status;
- support Account, Content, and transaction eligibility decisions where a geographic fact is relevant;
- support sanctions, export-control, regulatory, and other legal-compliance processes;
- perform analytics, diagnostics, capacity planning, and Service-performance measurement at an appropriate level of geographic granularity;
- investigate reports, disputes, security events, or anomalous activity; and
- comply with applicable law, valid legal process, or lawful governmental requirements.
Location-related information may be one input among several. Unless applicable law or the particular risk requires otherwise, MemeKick does not treat a single approximate network-location signal as automatically dispositive of residence, legal eligibility, fraud, sanctions status, or wrongdoing.
4. Open Culture Mode, Full Archive Mode, and Travel
4.1 Account-Level Participation
Open Culture Mode and Full Archive Mode are participation layers within the same MemeKick Account framework. MemeKick's operating principle is account-based eligibility, not automatic Mode switching based solely on a transient network location.
4.2 Temporary Travel and Network Changes
Temporary travel, roaming, a new IP address, a mobile-network change, or a different network-derived approximate location does not, by itself, automatically change a User's Open Culture Mode or Full Archive Mode or redefine the User's account identity.
MemeKick may nevertheless make a feature unavailable, request additional information, or apply another Service-level restriction when reasonably necessary to comply with sanctions, mandatory law, court or governmental orders, security requirements, fraud prevention, supported-market limitations, or other legitimate eligibility requirements.
4.3 VPNs, Proxies, and Network Routing
Use of a VPN, proxy, relay, corporate network, privacy service, or other routing technology can affect network-derived location. The use of such technology, by itself, is not treated as conclusive proof of fraud, residence, or eligibility. MemeKick may consider network-routing information as one security, integrity, or compliance signal and may request additional verification where reasonably necessary.
Users may not use technical means to evade a legal, sanctions, eligibility, or Service restriction that applies to them. MemeKick does not provide or endorse methods for circumventing those restrictions.
5. Location Signals, Legal Residence, and Eligibility
Approximate location, legal residence, nationality, citizenship, domicile, physical presence, supported-market status, and Service eligibility are not interchangeable concepts. MemeKick may need different information for different purposes.
For example, an IP-derived country signal may be useful for localization or security while being insufficient to establish legal residence for a regulated or restricted feature. Where a legally relevant geographic fact cannot reasonably be determined from available signals, MemeKick may request additional information or decline to make the relevant feature available until the necessary eligibility determination can be made.
MemeKick's geographic controls are intended to be reasonable and proportionate to the legal, safety, security, and operational risk. A location signal may trigger review or verification without, by itself, constituting a finding of wrongdoing.
6. Transaction Eligibility and the Non-Custodial Wallet Boundary
Location-related information may be used before submission of a MemeKick-mediated transaction to determine whether the applicable Account, Content, or contemplated action is eligible to proceed. Where a geographic or legal restriction applies, MemeKick may block or make unavailable the relevant transaction functionality.
A Service-level transaction restriction is different from control of a User's external non-custodial wallet. MemeKick does not represent ordinary location- or eligibility-based Service restrictions as a freeze, seizure, confiscation, or forfeiture of assets held in an external wallet.
Once a transaction has been submitted for Atomic Settlement, location-related enforcement does not by itself imply that MemeKick can selectively rewrite the settlement while it is executing. After completion, later location, eligibility, or Account changes may affect current access or future transaction permissions but do not by themselves erase or rewrite completed blockchain history.
7. Service Providers and Other Disclosures
Service providers that support hosting, security, fraud prevention, analytics, measurement, infrastructure, compliance, verification, communications, or other Service functions may process IP addresses, network information, or approximate location on our behalf or for the Service purpose for which they are engaged.
Location-related information may also be disclosed where reasonably necessary to comply with law, respond to valid legal process, protect Users or the Service, investigate fraud or security events, complete a corporate transaction, or as otherwise described in the MemeKick Privacy Policy.
This Policy does not govern location information independently collected by third-party wallets, app stores, websites, payment providers, analytics tools, blockchain interfaces, or other services that you choose to use, or the processing of your device location by your device's operating system, your web browser, and their location services, including the area-name lookup described in Section 2.2. Their practices are governed by their own privacy notices and terms.
8. Retention, Security, and Your Rights
We retain location-related information only for as long as reasonably necessary and proportionate for the purposes described in this Policy and the MemeKick Privacy Policy, taking into account security, fraud-prevention, transaction, compliance, dispute, accounting, legal, and technical needs.
The approximate device location and area names described in Section 2.2 are stored with the content they were attached to. They are deleted or de-identified when that content or your Account is deleted, unless we must retain them for a purpose described in this Policy or as required by law.
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security.
Depending on where you live and the law that applies, you may have rights concerning personal information associated with you, including rights to access, correct, delete, restrict, object to, or obtain information about certain processing. The MemeKick Privacy Policy explains applicable rights and how to submit a request.
9. Sale, Sharing, and Targeted Advertising
As of the Effective Date, MemeKick does not sell personal information as "sale" is defined by applicable U.S. state privacy laws, share personal information for cross-context behavioral advertising as defined by applicable California law, or process personal information for targeted advertising as defined by applicable U.S. state privacy laws, as further described in the MemeKick Privacy Policy.
MemeKick does not use precise device location, or the approximate device location described in Section 2.2, for targeted advertising. If MemeKick's advertising or location practices materially change, we will update the applicable disclosures and provide any notice, permission, consent, opt-out mechanism, or other control required by applicable law before the changed practice applies.
10. Future Precise-Location Features
A future feature that collects precise device location — that is, location more precise than the approximate device location described in Section 2.2 — will be treated as a material privacy and product change. Before enabling such a feature, MemeKick will evaluate the feature's necessity, data minimization, permission design, retention, security, third-party access, applicable legal requirements, and user controls.
Where permission is required, denial of precise-location permission will not be treated as consent. If a precise-location feature is optional, MemeKick will explain the effect of declining permission. If a feature cannot function without legally required location information, MemeKick may make that feature unavailable rather than collect the information without the required authorization.
11. Changes to This Policy
We may update this Policy to reflect changes in the Service, applicable law, technology, or our privacy practices. We will post the updated Policy and revise the "Last updated" date.
If a change is material, including a material change involving precise location, new location-based advertising, a materially different eligibility use, or another high-impact location practice, we will provide additional notice or obtain consent where required by applicable law before the changed practice applies.
